Terms of Service

1. Acceptance

By creating an account or using Qualify64 (“the Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. The Service

Qualify64 provides tools to create, customise, and embed calculator widgets on external websites for the purpose of capturing leads. The Service is provided on a subscription basis.

3. Your account

• You must provide accurate information when registering.
• You are responsible for keeping your password secure.
• You are responsible for all activity that occurs under your account.
• You must be at least 18 years old to use the Service.

4. Acceptable use

You may not use the Service to:

• Collect data without a lawful basis or required consents under applicable data protection law
• Deceive or mislead end users who interact with your embedded calculators
• Distribute malware or engage in phishing or fraudulent activity
• Violate any applicable law or regulation
• Resell or redistribute the Service without our written permission

5. Lead data and GDPR

You are the data controller for leads collected through your embedded calculators. You are responsible for having a lawful basis to collect that data, providing appropriate privacy notices to your website visitors, and complying with applicable data protection laws including GDPR where relevant.

6. Subscriptions and billing

• Paid plans are billed in advance on a monthly or annual basis.
• You may cancel at any time. Access continues until the end of the billing period.
• We do not offer refunds for unused portions of a billing period.
• We reserve the right to change pricing with 30 days notice.
• Payments are processed securely by Stripe.

7. Free plan limits

Free plan accounts are subject to lead capture limits as described on the pricing page. We reserve the right to modify free plan limits with reasonable notice.

8. Intellectual property

The Qualify64 platform, software, and calculator blueprint templates are our intellectual property. You retain ownership of the content and data you create within the Service.

9. Uptime and availability

We aim for high availability but do not guarantee uninterrupted access. The Service is provided “as is” without warranty of any kind.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including lost leads, lost revenue, or data loss.

11. Termination

We may suspend or terminate accounts that violate these Terms. You may close your account at any time from your account settings.

12. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. We will notify registered users of material changes by email.

13. Governing law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
